It’s a fact – in the Digital Era, people are becoming more concerned about how their personal data is captured, processed and shared. A survey by the Information Commissioner’s Office (ICO) showed that 97% of all UK respondents have concerns about businesses processing their personal information online; 75% of respondents stated that their greatest fear was that their information would be stolen for criminal purposes. Companies and organisations who don’t respect Data Privacy risk being fined. The also risk severely damaging their reputation:
· The Royal Borough of Kensington and Chelsea was fined £120,000 in April 2018 by the Information Commissioner’s Office (ICO) after it unlawfully identified 943 people who owned vacant properties in the borough.
· Following the Facebook / Cambridge Analytica data breach scandal, Facebook’s share price dropped by 25%, wiping $100 billion off the company’s market value. Mark Zuckerberg CEO stated, “We will dig through this hole, but it will take a few years”. Cambridge Analytica subsequently ceased to trade stating “media coverage has driven away virtually all of the company’s customers and suppliers. As a result, it has been determined that it is no longer viable to continue operating the business.”
Under the existing Data Protection Act (1998), it was already a legal requirement for all businesses to protect the privacy rights of all individuals for whom they hold data. With GDPR now being in force, an individual’s data privacy rights are increased along with the responsibility of businesses. Whilst businesses needed to be compliant on or before 25thMay 2018, GDPR also needs to be considered as a journey rather than a destination. Data is constantly changing and becoming GDPR-ready isn’t a one-time exercise. You will need to ensure that your business remains compliant.

We recognise that GDPR can be a daunting prospect and sometimes hear the following questions from our customers:
My business isn’t big enough – no one is going to check to see if I’m GDPR compliant!
Wrong! If you think that even the smallest businesses can operate under the radar of Data Privacy laws, you would be mistaken – an independent newsagent who operated CCTV on her business premises was recently fined and ordered to pay costs by the ICO.
It doesn’t take a data breach to have the ICO investigate. A complaint by an individual and/or the ICO suspecting non-compliance could also lead to investigation.
Hang on! We’re leaving the EU. Surely, I can therefore ignore GDPR?
Unfortunately not! With the deadline for Brexit not until 31 March 2019, the GDPR will be effective in the UK for more than ten months. Also, the UK government confirmed in August 2017 that they would transfer the GDPR into UK law after it leaves the EU.
